Some clients have the wrong idea. They believe the personal injury case is like winning the lottery. They believe there is no possible downside. While it is true, a lawyer usually doesn't take a "fee" unless there is a recovery, there are COSTS that cannot be ignored. You MAY be on the hook for those costs if things don't all work out in the best possible manner.

Here is an example: When I used to work as a defense lawyer for the insurance companies, we would often make offers on cases. In one case I remember vividly, plaintiff Vivian was offered $3500 prior to trial. It was a "take it or leave it" offer that she declined. Without getting into all the legal mumbo jumbo about this offer, she ended up owing the defense thousands of dollars because a jury ended up awarding her less than the $3500 we had offered. Some lawyers fail to inform their clients of this harsh reality.

In California, the defense can technically make you an offer, and if you reject the offer, you MAY be on the hook for their costs in defending the case. I have simplified the process for purposes of this article but the point remains - If you've been involved in a car accident or other injury case, you need to understand that you haven't won the lottery. You are entitled to reasonable compensation - economic and non-economic if the situation warrants it.

However, don't listen to lawyers who promise you millions of dollars only to get you to sign up with them. They are usually afraid to tell you how these lawsuits really work. They need to advise you of the pros AND cons of proceeding with your case. There are possible downsides, including the potential you will owe money to the defense.

I have too many years of experience handling these kinds of cases. I've learned that you MUST be candid with your clients. They really need to know what they are getting into and what the potential upsides and downsides might be.

When it comes to proper insurance coverage, there is one coverage that you really should not go without! That's "uninsured motorist" coverage. In handling personal injury cases, I've really come to appreciate the importance of Uninsured Motorist coverage!

Uninsured Motorist (UM) Coverage protects you in the event the party at fault did not have insurance at the time of the accident. It is perhaps the most critical piece of insurance, and most people ignore it. The ugly reality is that MANY people driving out there do not have any insurance at all. Also, in these economic times, many have chosen to view insurance as a discretionary item, even though California law mandates basic liability coverage. Some folks simply forget to pay their premium, and their insurance lapses. Therefore, if you are injured in an accident, YOUR insurance company will compensate you for your medical bills and pain and suffering if the other party had no insurance. Otherwise, you may have no where else to turn.

However, even if the other party has liability insurance, many times it is inadequate. In that case, most UM Coverage policies also include something called Underinsured Motorist (UIM) coverage. Did you notice that? It says "UNDER-insured." That means your UIM coverage will cover you if the other party's insurance was inadequate. That happens more often than you might think given that the bare minimum people need to get is $15,000 in liability insurance. There are so many people out there with the bare minimum, and that will not be enough if you have a serious injury. You may end up with nothing at all.

Most people I talk to don't really know if they have UM/UIM coverage on their policies. Some folks think their insurance company is trying to "upsell" them into something they don't need. I explain to them that in this day and age, UM/UIM coverage is VERY important. Also, your insurance company is more likely to be generous and fair with you in most cases because they owe you a fiduciary duty. The other party's insurance company doesn't owe you the same duty! Heck, they may not even return your phone calls! Take a look at your policy "declaration page" and see if you have it or not. Better yet, call your insurance professional.

How much UM/UIM coverage should you get? Consult with your insurance professional, but in my opinion, get as much as you can without breaking the bank. You may also want to explore an umbrella policy as well. If you or someone you know is involved in a serious accident, please consult an experienced attorney to get an opinion and act quickly because everything you do post-accident can be critical.

I once had a client who didn't "want to sue anybody!"  It was basically "against his religion" to bring any kind of claim against anyone.  He had fallen due to the negligence of another, and he re-tore his rotator cuff as a result.  Now he had a serious rotator cuff injury.  Well, now he is facing surgery as a result of this incident, and his shoulder is causing him tremendous pain on a daily basis.  He was supposed to be enjoying his retirement but now he is in great pain every day.  Because he tried to "tough it out" and didn't want to "bother anyone" with a claim, he made no mention of the accident to his doctors.  The only person who will suffer from that mistake is him.  Now the insurance company for the guilty party is denying the claim, arguing the accident never happened because my client did not mention it to his doctors.  Truth is my client was "old school" and didn't want to report his injury claim because he didn't want to be "a bother."  Well, now he needs rotator cuff surgery and the only one who suffered from his actions is himself.
