Auto/Truck Accidents

If you have been involved in a truck accident, then you are aware that it can be a life altering event. Often times, you are lucky to have survived. At Mountain Injury Law our truck accident lawyers have learned that truck drivers go long periods of time without a break. While regulations limit the number of consecutive hours they can spend on the road, these regulations often go ignored. Some truckers illegally drive for over 24 hours without pause. Countless hours on the road will take a toll on a driver’s ability to focus, concentrate, and remain alert. Truck drivers are already at a maneuverability disadvantage due to the size and nature of their vehicle. As a truck driver falls in and out of sleep, he becomes deadly. Our truck accident lawyers know from years of experience what evidence to seek. This includes what logbooks, receipts and other telltale evidence to look for in the discovery process. I was in an accident! please tell me what should I do? At Mountain Injury Law your personalized injury team will tell you the first thing you always want to do is get medical attention. Get there promptly by any means possible. Make sure the police are called. It is important that there is a police report completed for several reasons. First, it is important that information is collected from all the parties and witnesses to the collision. Second, although the at fault party may feel terrible and apologetic at the scene, people tend to want to change their mind once they fear repercussions from the insurance carrier; so it is nice to have them provide a statement to the police officer. If they later decide to change their story, it will appear less credible. Make sure you seek medical treatment, even if you feel “OK”. Many times in motorcycle accidents, the adrenaline is pumping so hard that your body masks your true injury. Also, it is possible you have sustained a head injury without realizing it. So it is important to document that you were concerned enough about your injuries to seek medical attention.

Motocycle Accidents

At Mountain Injury Law we tell our clients it’s what happens in the first 24 hours after a motorcycle accident can be critical to your case. My first bike was a 1976 Shovelhead HD and it met an untimely demise. I was serving at the time in the U.S.A.F and could not afford the loss. Many of you have been there. Of course, it is our hope you’ll experience years of safety on your bike and you’ll never have to worry about what happens after a motorcycle accident. However, if you do have an accident, it’s important that you take CERTAIN TIMELY steps to protect yourself. The first and most important thing to do after a motorcycle accident is to call the police and seek prompt medical attention. A medical professional should evaluate your condition and treat you immediately after the accident. Do all follow ups. Don’t fail to get the name, detailed contact information, driver’s license numbers, insurance information and vehicle description from all the drivers involved after a motorcycle accident. If you are unable to do this, ask someone to help you. After a motorcycle accident look for any witnesses who were on foot or in other vehicles and get detailed contact information from them, including their names, addresses, phone numbers, employers’ names, work numbers, and email addresses. Again, if you are unable to do this, ask someone to help you, even the police officer or emergency personnel on the scene. Talk to a lawyer who focuses on motorcycle accident cases as soon as possible. The sooner you do, the easier it will be to preserve the facts of the case. A good lawyer will respond immediately by visiting the scene, interviewing witnesses, and taking photographs. This will preserve any evidence related to what happened. It’s important to record the details of the accident while they are fresh in everyone’s minds. Protect yourself after a motorcycle accident by refraining from talking to anyone except for law enforcement officers about the case until you consult your lawyer. That includes other lawyers, witnesses and even your insurance company. When you do speak to law enforcement officers, stick to the facts. You are not required by law to give a statement to any insurance company, whether it’s another driver’s insurance company or your own. When they talk to you, insurance companies are looking for information that will help reduce the amount of money they will reimburse you for your accident. Although insurance is necessary for your protection, insurance companies are in the business of reducing costs and not helping you in a time of need.
